Application of These Terms and Conditions (The ‘LMG’ Agreement):
This website is operated by London Movement Group, which includes subsidiaries of London Movement Group ltd. (‘LMG’, ‘we’, ‘us’, or ‘our’). These Terms and Conditions (‘Terms’) govern your relationship with LMG, including, but not limited to, your use of the LMG website www.londonmovementgroup.com (the ‘Website’) your purchase of LMG classes, your rights to cancel your purchase of classes, your registration for classes, your communication with LMG, and your use of and attendance.

No persons under the age 18 shall be allowed to train with us at this time.

Consumers Right to Cancellation: (Memberships)
We want to ensure that cancelling your membership is straightforward. To do so, we require a 30-day notice period before your next payment is due. Please email us at team@londonmovementgroup.com to cancel your membership and include your name, address, and order reference. You must provide this information at least one month before your next payment is due to ensure that your cancellation is effective.

To ensure that your cancellation is applied to the right payment cycle, please provide notice before your next billing cycle starts. For example, if your billing cycle begins on the 10th of each month and you want to cancel for the upcoming month, you must provide notice by the 9th of the previous month. So, if you wish for your final payment to be on the 10th of March, you must cancel by the 9th of February to avoid paying on the 10th of April.

If you fail to provide timely notice, your next billing cycle will be charged, and your membership will be cancelled at the end of the following billing cycle.

Please note that refunds will not be given if you email us after your payment has been processed, unless it falls under the guidelines in the “Additional Rights to Cancellation of Purchase of Classes or Series of Classes” section. We also do not offer the option to pause or freeze your membership unless you provide a doctor’s note. However, if you are pregnant, you may freeze your membership. If you’re injured, we’ll pause your membership for a maximum of 6 months.

You may cancel your Contract in any of the following circumstances:

If you become disabled and, as a result, cannot physically participate in a class you have purchased, and your condition is verified by a doctor, LMG will refund you the purchase price of your unused class or classes.

If you die, LMG will refund your representative the purchase price of your unused class or classes.

If LMG stops offering classes, you may cancel your purchase.

Cancellation Policy for Reservations/Classes:
In order to cancel a reservation in a LMG class and return the credit to your account, you must reschedule/cancel 12 hours prior to the class. Once your reservation is cancelled, the class will be returned to your account to be used at a future date; the class is not refunded. If you haven’t cancelled by 12 hours before, your scheduled class will be charged, or members will be fined £15 for missed classes. You can cancel your reservation in the following ways:

On your scheduled appointment confirmation email, there will be a button stating “Cancel/Reschedule”. Please select this and choose the relevant alternative. This will be available up to 12 hours before the given booking. Within this time you will not be able to make changes to the booking.

If you are an unlimited member and do not cancel your class LMG reserves the right to fine you for the place taken at a cost of £15 a session.

FOR MEMBERS RUNNING LATE: We will hold a reservation for up to 5 minutes after class begins, though we cannot guarantee you will be given the space you signed up for. Members who are more than 5 minutes late will be admitted into class on the coaches discretion.

MEMBERS LEAVING EARLY: If you’re planning on leaving early, we kindly request that you tell the instructor ahead of time.

Cancellation Policy for 1-1 coaching hours:
We do not offer refunds for any packages of coaching hours. In specific circumstances we will do our best to allow alternative options, such as using the remaining credits for classes/small group coaching options where applicable.

Safety and Risks:
By signing up for and/or attending classes, events, activities, and other programs and using the premises, facilities and equipment (individually and/or collectively, you acknowledge that there are certain inherent risks and dangers with exercise equipment in association with the classes and use of the facilities. You acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries. You also acknowledge that the specific risks vary from one activity to another, but range from (1) minor injuries such as scratches, bruises, and sprains; (2) major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions; and (3) catastrophic injuries including paralysis and death.

In the absence of any negligence or other breach of duty by LMG, you hereby:

1. AGREE TO ASSUME FULL RESPONSIBILITY FOR ANY AND ALL INJURIES OR DAMAGE WHICH ARE SUSTAINED OR AGGRAVATED BY YOU IN RELATION TO THE CLASSES AND FACILITIES, WHETHER SUSTAINED WHILE USING EXERCISE EQUIPMENT OR NOT.
2. REPRESENT THAT YOU:
3. HAVE NO MEDICAL OR PHYSICAL CONDITION THAT WOULD PREVENT YOU FROM PROPERLY USING ANY OF LMG’S CLASSES AND FACILITIES;
4. DO NOT HAVE A PHYSICAL OR MENTAL CONDITION THAT WOULD PUT YOU IN ANY PHYSICAL OR MEDICAL DANGER.
5. HAVE NOT BEEN INSTRUCTED BY A PHYSICIAN TO NOT PARTICIPATE IN PHYSICAL EXERCISE.
You acknowledge that if you have any chronic disabilities or conditions, you are at risk in using LMG’s classes and facilities, and should not be participating in any classes.

Not Authorized to Perform Data Mining:
You are not authorized without the prior written permission of LMG to use any computer code, data mining software, ‘robot’, ‘bot’, ‘spider’, ‘scraper’ or other automatic device, or program, algorithm or methodology having similar processes or functionality, or any manual process, to monitor or copy any of the web pages, data or content found on this Website or accessed through this website. You also may not engage in the mass downloading of files from this website and use the computer processing power of this website and for purposes other than those permitted above; flood this site with electronic traffic designed to slow or stop its operation; or establish links to or from other websites to this website.

Not Authorized to Use This Website for Commercial Purposes:
Users are not authorized to sell, reproduce, distribute, modify, display, publicly perform, report or otherwise prepare derivative or second hand works based on any of LMG’s material in any way for any public or commercial purpose. Thus, you are not authorized to (i) resell or make commercial use of this site or its contents; (ii) collect or use any product listings, descriptions, photographs or prices displayed on this website in connection with the sale or resale of any LMG products or for other commercial purposes; or (iii) create, reproduce and/or distribute any materials derived from the content provided on this website. Furthermore, LMG’s material may not be displayed or communicated on any other website, in a networked computer environment or other digital support for any purpose whatsoever. In the event of breach of any of these terms, user’s permission to use LMG’s material will automatically terminate and any copies made of LMG’s material must be immediately destroyed.

Any unauthorized use of LMG’s material may violate state and federal criminal laws, infringe copyright laws, trademark laws, the laws of privacy or publicity, and communication regulations and statutes.

Our Liability
Nothing in these Terms shall limit or exclude LMG’s liability to you:

For death or personal injury caused by our negligence;
For fraudulent misrepresentation;
For breach of any term implied by the Consumer Rights Act 2015 and which, by law, may not be limited or excluded;
For any other liability that, by law, may not be limited or excluded.

Subject to this, in no event shall LMG be liable to you for any business losses, and any liability LMG does have for losses you suffer arising under these terms shall be limited to the greater of (i) any amounts paid or payable to LMG by you in the preceding six months or (ii) £200 and is strictly limited to losses that were reasonably foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both LMG and you knew it might happen.
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms that is caused by events outside our reasonable control.

Choice of Law:
These terms shall be governed by English law, except that if you live in a country (which, for these purposes, includes Scotland or Northern Ireland) of the European Union other than England, there may be certain mandatory applicable laws of your country which apply for your benefit and protection in addition to or instead of certain provisions of English law.

You agree that any dispute between you and LMG regarding these terms will only be dealt with by the English courts, except that if you live in a country (which, for these purposes, includes Scotland or Northern Ireland) of the European Union other than England, you can choose to bring legal proceedings either in your country or in England, but if LMG brings legal proceedings, we may only do so in your country.

The European Online Dispute Resolution platform http://ec.europa.eu/consumers/odr/ provides information about alternative dispute resolution, which may be of interest.

Please note that we have no obligation to agree to use this alternative dispute resolution method.

Acceptance of Terms
By using the website, purchasing a LMG class, registering for a LMG class, booking a space, purchasing merchandise, and/or using or attending a LMG class, you signify your acceptance of the terms. If you do not agree to this, please refrain from using the Website, purchasing a LMG class, registering for a LMG class, booking a space, purchasing merchandise, and/or using or attending a LMG class.
